An attorney at Cope Law Offices, LLC, can review your situation and develop a debt relief plan that effectively addresses these types of debts:
Unsecured Debts
Unsecured debts are completely dischargeable under Chapter 7 bankruptcy. Under Chapter 13 bankruptcy, your remaining unsecured debts will be discharged at the end of your repayment plan.
- Credit card debts
- Medical debts
- Personal loans
- Payday loans
- Second and third mortgages when the value of the home is less than the value of the outstanding first mortgage
Certain types of unsecured debts are not dischargeable. These include student loans, child support obligations and spousal support obligations. Certain tax debts may be dischargeable, though others may not be dischargeable.
Secured Debts
Secured debts include first mortgages, car loans and any other loans for which you have pledged property. A Chapter 7 bankruptcy can completely eliminate these debts, though you will lose that item unless your loan is reaffirmed. However, the extra cash flow you obtain from a Chapter 7 or Chapter 13 bankruptcy can make it much easier to cover your payments on your remaining debts.
